Resource: In-State Tuition Tracker

This resource provides a general overview of existing in-state tuition policies in 50 states as they apply to students who are refugees, Special Immigrant Visa holders (SIVs), humanitarian parolees, asylum seekers, asylees and Temporary Protected Status (TPS) holders.

It is important to note that this resource should NOT be used to determine whether a specific individual might be eligible for in-state tuition. There may be other pathways to eligibility for in-state tuition not captured in this resource. Please check with the relevant institution of higher education or seek legal assistance for individualized advice.

Some key points on utilizing this resource:

  • The relevant laws/policies are hyperlinked in the left-most column of the spreadsheet, and additional links are contained within each cell if applicable.

  • While many states have implemented various laws or regulations, implementation is often left to university systems or individual institutions, which can lead to variations among schools within the same state.

  • This resource is intended to serve as a starting point towards understanding the landscape of in-state tuition policies in each state. It does not comprehensively capture each and every policy that might exist in each state.

This resource was last updated on November 14, 2022 and is subject to change. While it will be updated periodically, recent changes to state in-state tuition policies might not be immediately reflected on this document.  If you have updated information, please contact Balqees Mihirig at bmihirig@refugeerights.org.

We would like to thank Tanya Broder, Senior Staff Attorney at the National Immigration Law Center, for sharing her knowledge and expertise, and the following University of Michigan IRAP chapter student volunteers for their invaluable research contributions:
